A Lovely Time

1. Rental Property

Holiday apartment Möwennest, in Ostsee-Ferienpark G-1-3, approx. 45 sqm in 23774 Heiligenhafen.

The tenant is provided with the furniture, kitchen, and dining utensils included in the rental property for use during the rental period. The inventory must be treated with care. All damage occurring during the rental period must be paid for by the tenant and reported immediately to the landlord or housekeeper. When leaving the apartment, the front door must be locked twice and the tenant must ensure that all electrical appliances are turned off.

Check-in is possible from 3:00 p.m. to 6:00 p.m., or by arrangement. For later arrivals, a fee of €10.00 will be charged unless the tenant notifies us before 5:00 p.m. On the day of departure, the apartment must be vacated by 11:00 a.m. at the latest.

The landlord is not liable for the tenant's personal belongings.

All keys are part of a locking system. If a key is lost, the tenant will bear the cost of replacing the cylinder and 6 keys. Minimum €250, proof provided by invoice from the owner/property manager.

Smoking is strictly prohibited in the apartment. In case of violation, the landlord is entitled to demand a contractual penalty. This is based on the effort to make the apartment smoke-free again. Minimum €300. The apartment has smoke detectors.

The maximum number of persons allowed in the rental property (including children and infants) is stated in the booking confirmation and must not be exceeded.

Holiday apartment Möwe G-1-3: maximum 3 adults and one infant in a self-brought crib. Upon request and confirmation from the landlord, a dog may be allowed.

The landlord reserves the right to exercise his house rights against unauthorized persons, particularly third parties not listed in the booking. This may also be exercised by persons authorized by the landlord.

Upon departure, the apartment will be inspected by the landlord or an authorized person. It is the tenant's responsibility to prove that neither they nor accompanying persons were at fault in case of damage. The tenant assumes liability for themselves and any accompanying children/persons. At the end of the rental period, the apartment must be left in a proper condition.

If a deposit (if specified) is required, it is due with the final payment. If no complaints are found on departure, the deposit will be refunded within 3 working days. No cash refund will be given after the end of the rental. The deposit is not interest-bearing.

The kitchen must be cleaned by the tenant and is not included in the final cleaning. In case of complaints, an increased cleaning fee may be charged afterward.

The landlord has the right to terminate the rental agreement in special circumstances, such as damage the landlord could not foresee and cannot quickly repair (water damage, fire damage, heating failure, storm or flood damage, etc.). In such cases, the landlord will attempt to find an alternative that matches the apartment in equipment, size, and price.

During the rental period, the tenant is responsible for keeping the apartment clean. If unexpected cleanliness issues arise upon arrival, the landlord or housekeeper must be informed immediately to allow for correction. Complaints made later cannot be considered.

As a bonus, the landlord provides Wi-Fi access during the rental period. See point 7.

Arrival / Departure / Key Handover

The apartment is generally available from around 3:00 p.m. on the day of arrival and until 11:00 a.m. on the day of departure.

The keys are handed over directly in the apartment by the owner or an authorized person, depending on the booking.

2. Pets

Pets of any kind are generally not allowed in the holiday park. With prior registration by the tenant and permission from the landlord, dogs may be brought to the Möwennest G-1-3 apartment.

  1. Dogs are not allowed on beds or seating furniture.
  2. Dogs may not be left unattended in the apartment.
  3. Dogs must be kept on a leash at all times in the park and on the premises.
  4. Waste must be properly disposed of.

A fee of €10 per day/night is charged for keeping a dog in the apartment. The landlord reserves the right to claim additional costs for damage or soiling caused by the animal. Unauthorized pet keeping entitles the landlord to terminate the contract without notice. No refund of already paid rent will be made.

3. Rental Price

The rental price includes utility costs for electricity, water, and heating. Service packages, special requests, extras, and tourist tax are not included and must be paid in addition to the rental price. If the rental price is not paid within the specified deadlines, the landlord is entitled to withdraw from the contract. In such cases, the tenant is liable for damages according to item 5 of these rental conditions.

4. Payment Terms

For bookings up to 60 days before arrival, a deposit of 30% of the rental price is due. From 30 days before arrival, 100% of the agreed travel price (incl. linen package, tourist tax, final cleaning, dog) must be paid. Cash payments are not accepted. We only accept payment via bank transfer.

5. Cancellation of the Rental Agreement/Booking

The cancellation of the rental agreement/booking by the tenant must be made in writing. In case of cancellation before the agreed rental start, the following cancellation fees apply:

Standard Rate: Up to 60 days before arrival: 30% of the agreed rental price From 30 to 14 days before arrival: 90% of the agreed rental price Later cancellations: 100% of the rental price
With the tenant's consent, the landlord may offer the apartment at a “last-minute” price. The tenant will bear and be charged the difference from the originally agreed price.

If the apartment is re-rented at the current seasonal price, a €60 processing fee will be charged. Processing and booking fees are non-refundable. In case of no-show, the full rental amount is due as compensation. Shortening the rental period is treated as (partial) cancellation and may lead to cancellation of the entire contract (e.g., if the minimum stay is undercut). Generally, it is possible to rebook any trip. For a rebooking, the valid standard price for the season applies. Rebookings under the standard rate are possible up to 30 days before arrival within the same or higher season and the same length of stay. For other cases, a fee of €35 applies.

If entry or overnight stays are prohibited by government regulation, free rebooking is possible in any season. Termination by the landlord: The landlord may terminate the contract without notice in accordance with legal provisions, for example in cases of force majeure, war, strike, or other serious reasons. If the tenant seriously disturbs other guests, uses the property contrary to the contract, or behaves offensively.

Disliking the apartment, property, or surrounding area does not entitle the tenant to withdraw from the contract. Early departure does not entitle the tenant to a partial refund of the rent.

7. Forgotten Items

Forgotten items will be kept for a maximum of 14 days. For returns, a handling fee of €10.00 plus postage and packaging costs will be charged. Bulky items will be charged based on effort.

8. Use of Internet Access via WLAN

The conditions are available in the apartment’s guest folder. (Due to COVID, data will be sent in advance by email.) By entering the login data / password / pin and thereby connecting to the Internet, these terms are accepted.

9. Processing of Data (Customer and Contract Data)

Privacy Policy: We collect, process, and use personal data only as far as necessary to establish, structure, or amend the legal relationship (inventory data). This is based on Art. 6 para. 1 lit. b GDPR, which permits data processing for contract performance or pre-contractual measures. We collect, process, and use personal data about the use of our services (usage data) only to the extent necessary to enable or bill the use of the service. Customer data collected will be deleted after completion of the contract or termination of the business relationship. Statutory retention periods remain unaffected.

10. Deposit

The landlord is entitled to demand a deposit with the final payment. The deposit will be refunded by bank transfer after departure.

11. Important Information on the 2G Rules: In many public areas, the 2G rule applies (Vaccinated/Recovered).

This means: To enter indoor spaces, one of the 2Gs and an ID card are required, e.g., in restaurants, hotels, fitness studios, or swimming pools. During key handover, the relevant proof and ID must be presented. Key handover is only possible if this proof is presented before entering the apartment.

10. Important Information on the 2G Rules

In many areas of public life, the 2G rule (Vaccinated/Recovered) applies. This means: To enter indoor areas, one of the 2G proofs along with an ID card is required, such as in restaurants, hotels/accommodations, fitness studios, or swimming pools.

During the key handover, the appropriate proof and ID must be presented.

Key handover is only possible once we have received the proof before entering the apartment.

We reserve the right to deny access to the apartment if no proof is provided. In this case, according to our terms and conditions (AGB), the booking is considered a no-show. (Point 6 paragraph 3 point 4)

11. Severability Clause

If any provision of this contract is not in accordance with applicable law, the rest of the contract remains valid. Instead of the invalid provision, a provision shall apply that complies with the law and comes closest to the intent of the original provision.
